Clean Water Act Issues
In 2002, a U.S. Court of Appeals ruled that certain pesticide applications near streams, lakes, and ponds were subject toClean Water Act (CWA) permits. The Environmental Protection Agency (EPA) issued proposed rules and interpretive guidance in January 2005 stating that CWA permits are not required under such situations. NASDA supports legislation (H.R. 1749 and S. 1269) introduced in the 109th Congress that addresses the court decisions and codifies EPA's rulemaking.
